Employers that Must Comply With DOT Regulations
Employers that must comply with DOT drug and alcohol testing regulations are those operating in industries regulated by the U.S. Department of Transportation (DOT) and its various agencies. This includes businesses involved in commercial motor vehicle transportation, aviation, maritime operations, railroad transportation, pipeline operations, and public transit. Specifically, employers regulated by agencies like the Federal Motor Carrier Safety Administration (FMCSA), Federal Aviation Administration (FAA), Federal Railroad Administration (FRA), Federal Transit Administration (FTA), Pipeline and Hazardous Materials Safety Administration (PHMSA), and U.S. Coast Guard (USCG) must follow strict drug and alcohol testing guidelines for employees in safety-sensitive positions. These roles include commercial truck and bus drivers, airline pilots and mechanics, train engineers, pipeline operators, and maritime crew members, among others. Compliance with DOT drug testing rules helps ensure public safety by preventing substance abuse-related risks in transportation and hazardous material handling.
What Employers Need to Do When an Employee Fails a DOT Drug Test?
A positive DOT drug or alcohol test can be a confusing and stressful situation for employers. What happens next? Is termination required? Can the employee ever return to work? The key to handling this correctly is following DOT regulations to ensure compliance and safety.
Immediate Steps After a Positive Test
When an employee tests positive on a DOT-required drug or alcohol test, the employer must act immediately. The employee must be removed from all safety-sensitive duties as soon as the verified test result is received. Employers should not wait for written confirmation from the Medical Review Officer (MRO) or the results of a split specimen test (if the employee requested one). A verified positive test is a direct violation of DOT regulations.
SAP Program for DOT
Employers are also required to provide employees who fail a DOT drug test—whether during pre-employment, random, reasonable suspicion, or post-accident testing—with information about qualified DOT Substance Abuse Professionals (SAPs). While employers are not required to pay for the SAP evaluation or treatment, they must provide a list of locally available DOT-qualified SAPs, including names, addresses, and phone numbers. Many employers choose to use a Third-Party Administrator (TPA) or service agents like American Substance Abuse Professionals (ASAP) to manage this process.
What is the DOT Return-to-Duty Process?
Employees who wish to return to safety-sensitive duties must successfully complete the DOT Return-to-Duty (RTD) process. This involves:
- Evaluation by a Qualified DOT SAP: The SAP assesses the employee and determines the necessary treatment or education program.
- Completion of Treatment and/or Education: The employee must comply with all SAP recommendations.
- Follow-Up Evaluation by the SAP: The SAP ensures the employee has met all requirements.
The length of the process depends on the severity of the case and the employee’s commitment to completing the SAP’s recommendations. A SAP is not an advocate for the employee or employer – their role is to ensure public safety by following DOT guidelines.
Returning to Work After Completing the SAP Process
Once an employee successfully completes the SAP’s recommendations, the SAP will provide written documentation to the employer confirming compliance. At this point, the employer may choose to return the employee to safety-sensitive duties, but only after the employee passes an observed DOT Return-to-Duty drug test.
Additionally, the employer must:
- Ensure the employee undergoes follow-up testing as outlined by the SAP.
- Report the Return-to-Duty test results and follow-up testing schedule to the FMCSA Clearinghouse.
